Content Policy

Userpeek offers a versatile platform that enables its clients to provide digital content ("Content") to individuals ("Participants") for feedback. Customers should be as transparent and clear as possible when defining the kind of Content that a participant will be exposed to via the Userpeek Platform in order to avoid scenarios in which participants are shocked or startled by the nature of Content delivered. Userpeek retains the right to promptly delete any Content that violates this Content Policy (or suspend any Test). We will attempt to contact you before removing or suspending your account.

If you see an undefined capitalized term in our Content Policy, it has the same meaning as in our regular Terms of Service.

Intellectual Property and Integrity

We prohibit and retain the right to delete any content that infringes on the patent, trademark, trade secret, copyright, or other intellectual property rights of a third party, or violates a copyright in direct violation of the Digital Millennium Copyright Act ("DMCA") or comparable legislation.

We prohibit any efforts to impersonate another person or to misrepresent your identity or association with any person or organization, and we have the right to delete any content that threatens the Platform's or Userpeek's reputation.

Security and Phishing

We are committed to ensuring the safety of our Customers and Participants. We work hard to guarantee that surveys or forms used for fraudulent or other harmful intents do not mislead Participants.

  • We will delete any Tests that seek to gather social security numbers, credit card numbers, passwords, or other sensitive personally identifiable information.

  • Additionally, we delete any Content that discloses a user's Sensitive PII against their desires.

  • We shall delete any Tests or other Content designed to deceive or mislead Participants or other users, by connecting to websites containing malware or other dangerous software.

  • Our Platform may not be used to intentionally and artificially improve the search engine ranking of a website, enlarge customer lists, or manipulate other marketing metrics.

  • Our Platform may not be used to host material whose sole purpose is to generate clicks or internet traffic to other websites, or to generate unsolicited email and/or SPAM (including any activity that would violate the CAN-SPAM Act of 2003 or comparable legislation).

Sexually Explicit Content and Nudity

We recognize that nudity and pornography may have a legitimation in some places. However, we strongly discourage the inclusion of such content on the Userpeek Platform.

  • You may not include pornographic content in Tests.

  • Nudity may be acceptable when shown in a scientific, journalistic, or artistic context as long as it does not cross the line into pornography. The depiction of nude minors is prohibited in any case.

  • We prohibit Content that portrays, threatens, or supports sexual assault, sexual violence, or sexual exploitation.

  • We prohibit any Content that exploits or endangers children sexually. In accordance with relevant legislation, when we become aware of apparent child exploitation, we report it to the National Center for Missing and Exploited Children (NCMEC) and/or other appropriate government agencies.

  • We propose including a prominent warning screen before presenting potentially offensive content.

Graphic or Violent Content

We permit graphic Content (with some restrictions) to assist individuals in raising awareness of concerns. We realize that people cherish the opportunity to address significant problems such as violations of human rights and acts of terrorism. We are also aware that people have varying sensitivity to graphic and violent content. Customers are strongly encouraged to put a warning label to any Test that contains graphic or violent Content, so that participants are aware of the graphic or violent nature of the Content before accessing it.

  • The depiction of violence in scientific, journalistic, or artistic contexts may be permissible.

  • We delete content that trivializes or glorifies violence.

  • We eliminate violent or gruesome Content that is meant to shock or disgust viewers, as well as Content that encourages others to engage in violent behavior.

  • We eliminate Content aimed at praising, promoting, or aiding violent criminal groups.

  • When we feel there is a serious danger of physical violence or direct threats to public safety, we delete content, disable accounts, and engage with law enforcement.

Suicide/Self-Harm

We delete content that promotes suicide or self-harm, with the exception of test sites that offer assisted suicide in countries where this is legal. Content on suicide/self-harm may be permissible in scientific, journalistic, and artistic contexts.

Hate Speech and Harassment

If we become aware of or suspect that there is a true danger of damage or threat to public safety, we may delete Material and submit information connected to that content to law enforcement authorities.

  • We delete Content that is intended to be degrading or humiliating.

  • Our Platform may not be utilized to directly or indirectly threaten or assault individuals, or to organize or promote acts of violence, harassment, or property destruction.

  • Our Platform may not be utilized for hate speech, or to advocate or support acts of hatred. Examples of hate speech include attacks on or advocacy for the abuse or exclusion of people on the basis of their ethnicity, national origin, political or religious affiliations, gender, sexual orientation, genetic predisposition, disability, medical or physical condition, veteran status, or any other legally protected class.

  • Our Platform cannot be used to harass or intimidate others.

Political and religious Topics

Political and religious topics are generally allowed as long as they do not violate the rules defined under "Hate Speech and Harassment".

The laws and regulations of the country in which the test is conducted must be observed and respected.

Firearms/Weapons

Content about firearms/weapons may be allowed in scientific, journalistic, and artistic contexts. We prohibit all content on trade with weapons, firearms, parts of firearms, firearms accessories and ammunition.

Drugs

Content about drugs may be allowed in scientific, journalistic and artistic contexts. 

Prohibited is all content on the production/trade of illegal drugs, non-medical drugs and prescription drugs, the trivialization and glorification of drug use and encouragement to consumption.

Test websites on the topic of Cannabis may be allowed if the test takes place in a jurisdiction where the purchase/consumption of Cannabis is legal.

Illegal Goods

We prohibit any content that involves buying, selling, giving away, exchanging or transferring anything that is illegal in the country where the test is conducted.

LGBTQ+

Content on LGBTQ+ topics is of course allowed. However, we urge you to keep in mind that there are still countries where such content might be criminalized. Userpeek wants to protect participants from these countries and also prevent possible damage to Userpeek. Userpeek therefore reserves the right to suspend such tests if necessary and to seek discussion with the customer. Involvement of Children

We prohibit the creation of tests or tasks that require parents to involve their children in the test. This may change in the future when Userpeek has defined appropriate rules and set up mechanisms that allow children to be involved in a way that can guarantee the well-being and safety of the children. For the time being, however, it is prohibited and we will terminate such tests immediately.
